Trucking Laws: Trucking Safety
Truck accident attorney Michael Leizerman describes the federal regulations regarding truckers driving in hazardous conditions and the relationship between state and federal regulations.
Almost one in four trucks inspected on the road are out-of-service. That means that they're dangerous enough that the federal law requires them to be immediately taken off the road. Not driven one inch further until the problem is fixed. The problem could be improper lights or brakes or one of many other problems. One in twelve drivers - on the average - is out of service upon inspection. This could mean anything from being not having a valid commercial driver's license to being under the influence of drugs or alcohol. It's also very troubling that about 1 in 16 trucks carrying hazardous materials are illegally on the road. The most recent available data compilation reports that about 100,000 people are injured in large truck and bus crashes each year and nearly 5,000 are killed. There is an average of around one death every daylight hour as a result of large truck crashes. All drivers should be taught, as outlined in the commercial drivers' license manual, to always be on the lookout for hazards on the road or potential hazards. A hazard is any potential for an unsafe situation. This can be a stopped car ahead, a person crossing the street, anything. A driver should always be looking far enough down the road to react to any new circumstance. A driver should always have a plan for an out in case of emergency. Like the pilot who amazingly put down his plane in the Hudson River, a good driver knows, the second a hazard appears, if they're swerving left or right, what traffic is around them, are they in a construction zone. This is what is expected of every professional driver on the road.
